Department of Employment and Labour postpones workshop on the Draft Construction Regulations

The Department of Employment and Labour Draft has postponed a Construction Regulations public comment awareness raising session until further notice.

The session, scheduled to be held at Emperors Palace, Kempton Park on 15 April 2025 will be held at a later date.

Department of Employment and Labour Director: Construction, Explosives and MHI, Phumi Maphaha said a new date will be confirmed soon, and the session will be held no later than 60 days. 

The workshop was to be held following the recent move by the Department of Employment and Labour to release and invite public comments on the repeal of Construction Regulations 2014.  

The draft construction regulations were promulgated on the 12 March 2025 for public comments. The key changes to the current construction regulations include:

                (a) revision of existing definitions

                (b) addition of new definitions

                (c) redefining the scope of construction work

                (d) introduction of construction health and safety manager appointment

                (e) acceptance of electronic health and safety files

 The Regulations are applicable to all persons involved in construction work for the duration of the project life cycle; owners of structures for the future lifetime of the structures; but exclude the construction work carried out is in relation to a single storey dwelling for a client who intends to reside in such dwelling upon completion thereof.

In terms of OHS interested persons who wish to comment on the draft regulations are invited to do so in writing within 90 days from the date of publication of the notice (12 March 2025).

The Construction Regulations public comment awareness raising session was to be held as part of highlighting the health and safety month.

The Department through the Inspection and Enforcement Services (IES) branch has been hosting weekly events nationally since the beginning of April 2025, and this will culminate with the national commemoration of the World Day for Health and Safety event that will take place in Bloemfontein.

The events are held under the 2025 World Day for Safety and Health theme: “The Impact of Digitalization and Artificial Intelligence (AI) on Workers' Safety and Health".
