Comments on Amended Skills Development Act

The Department of Labour is currently receiving public comments on
the amended new draft Funding and Service Level Agreement Regulations
that seek to strengthen the Sectoral Education and Training Authorities
(SETAs) as the key implementation agents of the government?s skills
development strategy.
The closing date for comments is set for Wednesday 11 February
2004.
The two new Regulations are established by the Skills Development
Amendment Act, -which is aimed at streamlining and enhancing the
ability of the Department of Labour to skills development and to enable
the National Skills Development Strategy to gather pace.
Among others the new Regulations sets a new obligation on all SETAs
to enter Service Level Agreements with the Department that clearly set
out performance outcomes, and very clear steps, should any SETA fail to
meet its obligations in terms of these Agreements.
The Amendments also gives Minister of Labour Membathisi Mdladlana
vested powers to regulate SETA administration with regard to salaries
and allowances of board members and making SETAs accountable to the
Public Finance Management Act.
The new Act further establishes 20 Employment and Skills Development
Lead Employer pilot projects to accelerate the uptake of learners from
small and medium enterprises and non-governmental organisations.
The Lead Employer project will start operating in March 2004.
