Basic Guide to Working Hours (Children in Performing Arts)

The maximum working hours including meal breaks, rest periods, and night work allowed for children.

Application

Sectoral Determination 10 for Children in the Performance of Advertising, Artistic and Cultural Activities applies to all employers who have been granted a permit to employ child workers under 15 years of age, but not to –

members of the:
- National Defence Force,
- National Intelligence Agency, or
- South African Secret Service;
unpaid volunteers working for charity;
workers aged 15 or older;
children participating in non-profit activities; and
employers who have not been granted permits.

The Basic Conditions of Employment Act applies in respect of any matter not covered by this sectoral determination.

Basic conditions of employment applicable only to children in the performing arts and their employers

Maximum Working Hours

The maximum working hours for children who are –

11 years and older are 4 hours per day
10 years and younger are 3 hours per day.

Maximum hours to be present at the workplace

Employers may not require or permit a child to be present at the workplace on any day for longer than –

6 hours for children younger than 5 years;
8 hours for children between the ages of 5 and 10 years;
10 hours for children older than 10 years.

Rest Period

Employers must give a child a break of at least 30 minutes after –

2 continuous hours of work
1 and ½ continuous hours of work for children 10 years and younger

Food and Refreshments

Employers must provide children with nutritious food and drinks appropriate to the age of the child at all times.

There must be a separate eating area for children where only the parent, legal guardian or child minder is allowed.

Night Work

A child may only be permitted to do night work between the hours of 10pm and 5am if the –

parent or legal guardian has agreed to in writing
employer has provided written reasons why the work needs to be performed at night
child is given an allowance that is agreed to by the parent or legal guardian
at the request of the parent or legal guardian, a child undergoes a medical examination, at the expense of the employer
