Basic Guide to Sick Leave (Learnerships)

Learners are entitled to 1 day’s sick leave for every 26 days worked.  An agreement may be reached whereby additional days are gained for less pay.

Application

  1. The Sectoral Determination 5: Learnerships applies to-
    • the employment of a learner –
      • who has concluded a learnership agreement; and
      • who was not employed by the employer party to the learnership agreement when the agreement was concluded; and
    • every employer who employs a learner.

The Basic Conditions of Employment Act applies in respect of any matter not covered by this sectoral determination.

Number of Leave Days

During their learnership learners are entitled to 1 day’s sick leave for every 26 days’ work or training.

Pay for Sick Leave

Employers must pay learners the normal allowance on payday.
 
Additional sick leave days taken, learners may, by agreement be paid at least 75% of the normal daily wage.

Proof of Illness

An employer may require proof of illness before paying learners who are absent on more
than -
  • 2 consecutive days or 
  • 2 occasions in an 8-week period.
Unless a learner can produce a medical certificate, an employer can withhold pay from a learner for sick leave.
 
An employer must help a learner who lives on his premises to obtain a medical certificate.
