Basic Guide to Family Responsibility Leave (Learnerships)

Learners are entitled to 3 days’ family responsibility leave if they have been employed for longer than 4 months.

Application

  1. The Sectoral Determination 5: Learnerships applies to-
    • the employment of a learner –
      • who has concluded a learnership agreement; and
      • who was not employed by the employer party to the learnership agreement when the agreement was concluded; and
    • every employer who employs a learner.

The Basic Conditions of Employment Act applies in respect of any matter not covered by this sectoral determination.

Number of Leave Days

Learners who –
  • have been employed for more than 4 months; and
  • work for at least 4 days a week for an employer
  • are entitled to 3 days’ paid family responsibility leave during each annual leave cycle.

Reasons for Leave

Learners may take paid family responsibility leave -
  • when their children are born,
  • when their children are ill,
  • in the event of the death of their –
    • spouse or life partner,
    • parent or adoptive parent,
    • grandparent,
    • child or adopted child,
    • grandchild, or
    • sibling.

Pay

Employers must pay learners the normal daily wage for family responsibility leave. This is to be paid on the normal payday.

Proof

Employers may require reasonable proof of the birth, illness or death for which a learner requests leave.
