Basic Guide to Annual Leave (Civil Engineering)

Sectoral Determination Two requires that workers get a minimum of 15 working days of annual leave each year. 5 days can be taken any time and 10 days are compulsory during a shutdown period.

Application

The sectoral determination for civil engineering applies to employers and workers in the civil engineering sector, but not to-

senior managerial workers;
workers earning more than R56 000 a year; and
workers engaged in emergency work.

The Basic Conditions of Employment Act applies in respect of any matter not covered by this sectoral determination.

Number of Leave Days

Workers must get annual leave of at least –

15 working days;
5 days can be taken at anytime;
10 days compulsory during shutdown period.

Timing of Leave

Both the employer and worker should agree to the timing of leave. If they cannot agree, the employer makes the final decision.

Leave must be granted not later than 6 months after the end of the annual leave cycle (12 month periods from date of employment).

Pay Instead of Annual Leave

Employers may not pay workers instead of granting leave, except on termination of employment.

Annual Leave and Public Holidays

A public holiday cannot be counted as annual leave.
