Form LRA3.23 - CCMA application to settle demarcation dispute

According to Section 62(1) of the Labour Relations Act any trade union, employers' organisation, worker, employer or bargaining council may ask the CCMA to determine whether -
  • any worker, employer, class of workers or class of employers is employed or engaged in a certain sector or area; and
  • any arbitration award, collective agreement or wage determination is binding on any worker, employer, class of workers or class of employers.

What is The Purpose of This Form?

To apply to the CCMA to settle a demarcation dispute.

Who Fills in This Form?

Any registered trade union or employer organisation, worker, employer or bargaining council.

Instructions

A copy of the form must be served on the other parties in the dispute.

Proof that a copy has been sent to other parties must be supplied by attaching -

  • a copy of a registered slip from the Post Office;
  • a copy of a signed receipt of hand delivered;
  • a signed statement by the person delivering the form;
  • a copy of a fax confirmation slip; or
  • any other satisfactory proof.

Attach copies of the relevant collective agreements.

Send a copy of the form to NEDLAC and attach proof that it has been delivered.
