Form LRA3.13 - Refer Public Service Jurisdictional Dispute to CCMA for Arbitration

Section 38(4) of the Labour Relations Act allows bargaining councils to request the CCMA to arbitrate on disputes.

What is The Purpose of This Form?

If there is a dispute between 2 or more bargaining councils in the public service, and the dispute has been referred for concilliation and is unresolved, any party may request the CCMA to arbitrate the dispute.

Who Fills in This Form?

Any party to the dispute.

A copy of the form must be served on the other party.
 
Proof that a copy of the form has been served on the other party must be supplied by attaching -
  • a copy of a registered slip from the Post Office; or
  • a copy of a signed receipt if hand delivered; or
  • a signed statement confirming service by the person delivering the form; or
  • a copy of a fax confirmation slip; or
  • any other satisfactory proof of service.
