Form BCEA6 - Application for Ministerial Determination

Section 50 of the Basic Conditions of Employment Act allows
for the Minister to replace or exclude any basic condition of
employment for any category of worker or employer if
an application is submitted by the employer and/or employers'
organisation.
Applications for a Ministerial determination must be in the form
of BCEA 6, or contain the same information as the form.
What is The Purpose of This Form?
To apply for a Ministerial Determination to replace or exclude
provisions of the Act or a Sectoral Determination.
Who Fills in This Form?
The employer.
Instructions
Employers must mention the section of the Act or Sectoral
Determination that they want variation on.
Employers must also include -
- proof of consent by the registered trade union, or if no consent is obtained, proof of service on trade union;
- shift rosters;
- reasons for not being able to comply
- financial statements (for variation of minimum wages).
