Commission for Employment Equity
This Commission was established in terms of section 59 (1) of the Basic Conditions of Employment Act, 1997 (BCEA).
The functions of the Commission are to advise the Minister on:
§ the making of sectoral determinations;
§ any matter concerning basic conditions of employment;
§ any matter arising out of the application of the BCEA;
§ the effect of government policies on employment;
§ collective bargaining trends and whether any of them undermine the purpose of BCEA;
§ The ECC also advices the Minister of Labour and the Minister of Social Development on any matter concerning the employment of children, including the review of s43 (Prohibition of employment of children);
§ The ECC is also empowered to advise the Minister of Public Service and Administration on any matter concerning basic conditions of employment in the public service.
